Terms of Service

1. Agreement to Terms

By accessing or using Speechbox ("the Service"), operated by Danielle Dafni ("we" or "us"), you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Description of Service

Speechbox is a SaaS platform that transcribes video content and generates content assets including social posts, quotes, blog posts, newsletters, and more. The Service is available at prism.speechbox.ai.

3. Plans and Payment

Speechbox offers a free trial of 10 minutes of video processing. To continue, you purchase one-time minute packs. Current pack sizes and prices are shown on our pricing page.

Minute packs are one-time purchases. There is no subscription, no recurring charges, and your purchased minutes do not expire.

Payments are processed by our authorized third-party payment processor, which handles billing and payment processing. By making a purchase, you agree to the payment processor's terms of service.

4. Refund Policy

We offer a 14-day money-back guarantee on any purchase, for any reason, with no exceptions or conditions. To request a refund, contact us at contact@speechbox.ai within 14 days of the transaction. For the full policy, see our Refund Policy.

5. Acceptable Use

You agree not to use the Service to:

• Upload content you do not have rights to use.
• Generate content that is defamatory, harassing, or illegal.
• Reverse-engineer or misuse our infrastructure.
• Circumvent usage limits or access controls.

6. Intellectual Property

You retain ownership of the videos you upload. By using the Service, you grant us a limited license to process your content solely to provide the Service.

The Speechbox platform, its design, AI models, and output templates are our proprietary property. You receive a non-exclusive license to use the outputs generated from your content.

7. Data and Privacy

Your use of the Service is governed by our Privacy Policy, incorporated into these Terms by reference. We use AssemblyAI for transcription and Google Gemini for content generation as sub-processors.

8. Limitation of Liability

To the maximum extent permitted by law, Speechbox shall not be liable for indirect, incidental, or consequential damages. Our total liability shall not exceed the amount you paid us in the 3 months prior to the claim.

9. Termination

We may suspend or terminate your account if you violate these Terms. You may stop using the Service or close your account at any time. Purchased minutes are non-transferable, and any unused minutes are forfeited on termination except where our 14-day money-back guarantee applies.

10. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email. Continued use after changes constitutes acceptance.

11. Governing Law

These Terms are governed by the laws of the State of Israel. Disputes shall be resolved in the courts of Tel Aviv.

12. Publicity and Customer Identification

By purchasing a paid Speechbox plan or service, you grant Speechbox a non-exclusive, worldwide, royalty-free, revocable license to use your name and logo solely to identify you as a Speechbox customer on the Speechbox website and in Speechbox marketing materials.

This use is limited to statements of fact about the customer relationship and does not imply your endorsement of Speechbox. We will comply with any reasonable brand or trademark usage guidelines that you provide to us in writing.

You may withdraw this permission at any time by emailing contact@speechbox.ai. We will remove your name and logo from our forward-facing materials within thirty (30) days of such request, except where they remain in already distributed or archived materials that cannot reasonably be altered.

This license does not extend to any use that disparages you or misrepresents the relationship. You retain all ownership of your name, logo, and trademarks.

13. Copyright, Illegal Content, and Notice-and-Takedown

We respect intellectual property rights and prohibit the use of the Service to upload, process, or distribute content that infringes the rights of others or is otherwise illegal. We respond promptly to notices of alleged infringement or illegal content.

If you believe content processed through the Service infringes your copyright or other rights, or is illegal, please send a notice to contact@speechbox.ai that includes:

• Identification of the work or material you claim is infringed or unlawful.
• Identification of the material on the Service and information sufficient to let us locate it.
• Your name, address, and contact details.
• A statement that you have a good-faith belief that the use is not authorized by the rights holder, its agent, or the law.
• A statement that the information in your notice is accurate, and that you are the rights holder or authorized to act on the rights holder's behalf.
• Your physical or electronic signature.

On receipt of a valid notice, we will promptly remove or disable access to the reported content and may suspend or terminate the account responsible. We may also remove content and suspend accounts on our own initiative where we identify a violation of these Terms or applicable law.

We will terminate, in appropriate circumstances, the accounts of users who are repeat infringers.

If you believe content was removed in error, you may submit a counter-notice to the same address explaining the basis for reinstatement, and we will review it in good faith.
